An Overview Of Florida Parental Relocation Laws

Florida courts require advance permission for parents planning in-state or out-of-state moves of at least 50 miles. Courts will also consider modifications for moves within 50 miles. Relocation requirements apply while divorce and custody proceedings are pending and after establishing a time-sharing arrangement.

Courts have the final say in all relocation requests. Florida designed its laws to ensure that any move aligns with the child’s best interests. Parents must follow these rules regardless of whether they are on the same page:

When Parents Agree:

  • Provide a written agreement reflecting the consent of both parties
  • Offer specifics about a new time-sharing schedule and transportation arrangements

When Parents Disagree:

  • The parent wanting to relocate must file a petition containing a detailed description of where and when the move is planned.
  • Each parent must present detailed reasoning for or against the move.
  • Each parent must provide evidence that the relocation is or isn’t in the child’s best interest.
