How does Florida decide child custody and time-sharing?
Florida uses different terms for child custody. Parental responsibility, or decision-making, relates to each parents’ right to make decisions for their child, about things like education, health care and religion. This responsibility can be shared or awarded to one parent.
Time sharing refers to the time each parent has with their child according to a court-approved parenting plan. The child can spend approximately the same amount of time with both parents or live primarily with one.
For both types of custody, judges consider factors like:
- The child’s relationship with each parent
- The parents’ mental and physical health
- The child’s home, school, and community record

When is it permissible to reduce child support payments?
Child support payments may be adjusted in Florida when a parent’s or a child’s circumstances change significantly. These changes might include unemployment, large income swings for either parent, disability or changes in your child’s needs.
Your situation is unique. I will carefully evaluate your circumstances to determine when adjustments are warranted. If so, I will file the appropriate paperwork with the court and advocate for you in any court hearings.
How is a custody order affected if I move inside Florida or leave the state?
Relocation is one reason that may necessitate a parenting plan modification in Florida. A court must typically sign off if you plan an out-of-state move or in-state move of more than 50 miles.
Judges put the child’s best interests first when deciding whether to grant these requests. They will weigh factors like whether the move allows the child to maintain a close relationship with both parents.
